Files sent with inquieries will not be saved.
All other work and correction cost will be calculated according to real cost and are paid by the customer.
Jamnik d.o.o. is not responsible for orders that technically deviate from the specifications on the corresponding offer. With your order relating to a specific offer, you explicitely agree to the technical specification of the corresponding offer.
Only the products that are identified as such on this document are FSC® certified.
If the offer for packaging contains GD cardboard (100% recyclable material) and design is complex printed (e.g. greater coverage of the sheet, large surfface of dark color…), the client agrees not to make claims for the errors in the cardboard (e.g. dots, smaller grease stains, small cracks on the surfface…). In the case of such printed materials or designs we suggest the client to replace the GD cardboard with GC cardboard which will be free of these irregularities, however, the replacement requires price adjustment and a new offer.
The following data, which you provided to us for the purpose of forwarding the official offer - e-mail address, person's name, company name, will be entered into our database of e-news recipients and used for the purpose of sending e-news to your e-mail address. Agreed delivery date is only valid if the customer provides us with all the necessary items (sample and drawing confirmation, best proof confirmation, etc.) within the agreed terms. If the confirmation time is exceeded by the customer, the delivery date is postponed at least for the exceeded time from the customer.
We shall not be liable for defects on goods in stock at our warehouse for longer than 6 months.
The buyer is obliged to notify the seller of any evident defects (like wet or damaged pallets) by notice on the CMR or the delivery note, immediately upon recieving the goods. We cannot accept later claims.
Complaints are considered within 8 days of receiving the goods. For hidden defects within 6 months from production, provided that the goods are properly stored (humidity 40-60%, temperature 20-25 degrees, protected in foil)!
EURO pallets are the property of the sender and are returnable unless agreed otherwise. If the customer does not return the EURO pallets, they will be charged at the market price.
The customer guarantees that usage of the contract transferred documents (designs, pictures, logos, patterns, samples, etc) on any existing copyrights, trademark rights or other rights of third parties is checked. Jamnik is not liable for any infringement of such rights. If Jamnik is held liable for any such violation, the customer shall indemnify and hold harmless Jamnik. The customer has to replace Jamnik all the disadvantages caused by a third party claims.
In the case of delivery by express mail, please check the shipment immediately upon receipt, as the following provisions apply if you wish to complain about the shipment. If you notice damage to the packaging during express mail delivery, you must notify the delivery person and fill out a damage report together with him. Complaints regarding the contents of the shipment are accepted by the sender within 15 days from the date of delivery.
Obračun DDV za podjetja iz EU
Pomembno obvestilo za poslovne kupce (B2B)
Za podjetja s sedežem v EU, ki pri nas naročajo blago ali storitve, velja naslednje:
- Je naročnik tuje podjetje (lahko ima tudi veljavno ID za DDV – davčno številko v sistemu VIES),
- Blago ali storitev pa se dostavi na naslov v Sloveniji (npr. v podjetje za pakiranje, logistiko, skladiščenje ipd.), in
- Račun je izdan na tujega naročnika (EU podjetje),
Smo v skladu z zakonodajo dolžni obračunati slovenski DDV, saj je kraj dobave v Republiki Sloveniji. Oprostitev DDV ni možna, tudi če ima naročnik veljavno EU davčno številko, če blago fizično ne zapusti Slovenije.
Kako zagotoviti oprostitev slovenske stopnje DDV?
Za znotraj skupnostno dobavo blaga brez obračuna DDV morajo biti sočasno izpolnjeni naslednji pogoji (skladno s pravili EU in slovenskimi davčnimi predpisi):
- Prejemnik ima veljavno ID za DDV (davčno številko) in je registriran v sistemu VIES.
- Blago se dejansko odpošlje iz Slovenije v drugo državo članico EU.
- Obstaja ustrezno dokazilo o prevozu (npr. CMR, dobavnica, odpremnica ipd.).
- Transakcija je ustrezno dokumentirana in prijavljena v intra-EU poročilih (Recapitulative Statement).
Kaj če pogoji niso izpolnjeni?
Če kateri izmed teh pogojev ni izpolnjen, smo v skladu z zakonodajo dolžni obračunati slovenski DDV, ne glede na:
- Sedež naročnika,
- Njegovo registracijo za DDV v drugi državi članici,
- Ali ima veljavno davčno številko (DŠ) v sistemu VIES.
V takem primeru ima kupec pravico, da v svoji državi zahteva povračilo slovenskega DDV preko postopka refundacije DDV po 9. Direktivi Sveta EU (t. i. VAT Refund za podjetja iz EU).
Ti pogoji veljajo za vse ponudbe in naročila. Z oddajo naročila potrjujete, da ste seznanjeni s pogoji obdavčitve.
